Court fee

Court fees are the fees payable by the complainant or appellant against a court judgement. In 2021 the fee is 1199,- norwegian kroner.

If you win the case, the opposing party can be ordered to pay the court fee as part of the judgement on awarding case costs.

The number of fees payable varies according to type of case and how extensive it will be.

In some cases, no court fees are payable. These include child custody cases, paternity cases, etc. See section 10 of the Act on Court Fees (lovdata.no).

Free legal aid can also imply waiving court fees.

A party not using a lawyer has to pay the court fee in advance.

If a party asks the court for lay judges or to appoint an expert, extra fees will be payable.

Common process - District Court

The entry fee is 5 995 kroner (5 R)  and includes the first day of the main hearing. The fee increases by 3 597 kr (3 R) for each court day up to and including day 5. As from day 6, the fee increases by 4 796 kr (4 R). If the case has been heard by the Conciliation Board, the payment will be reduced by 1 388 kr (1,15 R).

Cases that do not end in judgement:

  • if the case has been rejected, not been referred or cancelled: 2 398 kr (2 R)

  • if the case is settled/withdrawn more than 4 weeks before main hearing; 2 398 kr (2 R)

  • if the case is settled/withdrawn less than 4 weeks before main hearing: 2 997,- kr (2.5 R).

  • if the case is withdrawn or settled is reached durin main hearing, half of the full fee is payable. 

  • Judgement in absentia: 2 997 kr (2.5 R).

Small Claims Process (chapter 10, the Dispute Act)

Cases tried according to the rules of the Small Claims Process that have been heard by the Conciliation Board are subject to a fee of 2.5 R. If a case has not been heard first by the Conciliation Board, payment increases to 3.5 R.

Declaration of invalidity

Declaration of invalidity:  959 kr (0,8 R).

Valuation:

  • 5 995 kr (5 R) for each day valuation is held.

  • 2 398 (2 R) if valuation is cancelled before the first day.

Enforcement and temporary injunction order

  • Requesting enforcement: 1 318 kr  (1.1 R), even if the request is later withdrawn or rejected.

  • Requesting disbursement, also from other countries: 2 038 kr (1.7 R).

  • Complaint to District Court in cases about compensation order:  1 199 kr (1 R).

  • Seizure and temporary injunction order: 2 998 kr (2.5 R).

If the court decides on other types of enforcement, another fee will be applied. See details of the types of enforcement and fees in the Act on Court Fees on www.lovdata.no.

Notarial certification (notary public)

299 kroner (0, 25 R) for notarial certification. 

Storage of testaments

The storage of wills and testaments by the court costs 950 kroner (0.8 R).


Appeals and hearing in the Courts of Appeals and Supreme Court

Appeal hearing: 28 776 (24 R).

The same applies to appeals in cases heard according to the rules for Small Claims Process. Only  4 796 (4 R) is payable if the Court of Appeal overturns the judgement according to section 29-12(2) of the Dispute Act.

In the event of a derivative, a court fee is payable of  28 776 kr (24 R).

Cases that do not end in judgement:

  • If the appeal is rejected, not been referred or cancelled:  2 398 kr (2 R).

  • Appeal against verdicts and decisions: 7 194 kr (6 R).

  • If the case is settled/withdrawn within 4 weeks before main hearing: 2 398 kr (2 R).

  • If the case is settled/withdrawn later than 4 weeks before main hearing: 14 388 kr (12 R).

  • If the case is withdrawn or settlement reached during the main hearing, half of the full fee is payable

For appeal hearings that lasts for 1 day and more

1 day: 28 776 kr (24 R)

3 597 kr (3 R) per day until day 5.

4 796 (4 R) more per day from day 5.
