The defendant in a court case is the person the claimant has brought a case against. This page provides details of the role and rights of a defendant.

The defendant has more or less the same rights and duties as the claimant. The most important are

  • The defendant must be called to attend all court sessions for the case, and must attend if ordered to do so.

  • He or she can opt to represent him/her self or have a lawyer to do so. He/she can call witnesses and present other evidence. 

  • He/she must give truthful and complete testimony and take an oath declaring that he/she will do so.

  • If in disagreement with the decisions the court makes, he/she can usually have them tried by a higher court.
