New grand chamber hearing

The right to claim compensation for alleged breaches of EEA law by the courts.

On 20 November 2025, the Supreme Court’s Appeals Selection Committee decided to refer the appeal against Eidsivating Court of Appeal’s order of 9 October 2025 to the Supreme Court.

Subject matter:

The right to claim compensation for alleged breaches of EEA law by the courts. The extent to which the limitations in section 200 subsection 3 of the Courts of Justice Act must give way in the light of obligations under the EEA Agreement.

On the same day, Chief Justice Toril Marie Øie decided that the case will be heard by the Supreme Court sitting as a grand chamber composed of 11 justices.
