A Supreme Court justice had been a passive member of the trade union NTL since she started working after her studies 32 years ago. This did not disqualify her from serving as a judge in a case regarding a business transfer where NTL acted as third-party intervener, see section 108 of the Courts of Justice Act. There were no special circumstances likely to diminish the trust in the justice's impartiality in the case. The fact that an objection to her participation had been submitted was not decisive.
