Preventive detention for attempted homicide
Supreme Court judgment 10 June 2020, HR-2020-1218-A, (case no. 19-191016STR-HRET), criminal case, appeal against judgment.
The Public Prosecution Authority (Counsel Alvar Randa) v. A (Counsel Halvard Helle)
Justices: Indreberg, Webster, Kallerud, Arntzen, Steinsvik
The penalty for seven homicide attempts, see section 275, cf. section 16 of the Penal Code, and several other acts of violence and threats was 11 years of preventive detention with a minimum term of seven years and six months. The convicted person had shot at seven persons standing outside a club, injuring three. He had also previously been convicted of aggravated violence. The risk of new acts of violence was high. A fixed term of imprisonment would not be sufficient to protect other people's life, health or liberty at the expiry of the penalty. Nor did anything indicate a change process that would reduce the future risk of new aggravated offences.
