Sentence for fraud committed by a member of the Storting

Supreme Court judgment 13 October 2020, HR-2020-1945-A, (case no. 20-097027STR-HRET), criminal case, appeal against judgment.

The penalty for violation of section 372, see section 371 (a) was 11 months of imprisonment. The convicted person, who had been a regularly attending deputy member of the Storting, had over a period of around three years submitted travel reports and been reimbursed expenses for travels that had never taken place, in an amount of nearly NOK 450 000. Considerable weight was given to fact that he had committed a serious breach of trust in the capacity of a member of the Storting, which justified a stricter sentence than what the size of the fraud amount suggested considered in isolation. Section 77 (j) of the Penal Code was applicable. His unreserved confession was a mitigating factor.
