Sentence for illegal possession of firearms

The sentence for violation of section 190 of the Penal Code was 60 days of imprisonment. The convicted person had without a license been in possession of a pistol and a machine pistol, as well as ammunition. The weapons were not stored in a safe place. Neither of them functioned. The pistol was relatively easy to repair, while the machine pistol had so large defects that the potential for harm was highly limited. The convicted person had previously been convicted four times of violations of the Weapons Act. The Supreme Court took as a starting point a sentence of 40 days of imprisonment, and added 20 days for recurrence, see section 77 (k) and section 79 (b) of the Penal Code.
