90 days of imprisonment for storage of pistol

Supreme Court judgment 14 September 2023, HR-2023-1677-A, (case no. 23-082038STR-HRET), criminal case, appeal against judgment. 

A (Counsel Øystein Ola Storrvik) v. The Public Prosecution Autority (Counsel Stein Vale)

The Court of Appeal had set the penalty for violation of section 191 see section 190 subsection 1 of the Penal Code, see section 5 subsection 1 of the Weapons Act at 90 days of imprisonment. The defendant had left a semi-automatic pistol with 15 live rounds in the magazine on the living room table of an acquaintance, in a flat to which a number of people had access. The possession of the weapon was connected to a criminal environment. The Supreme Court agreed with the Court of Appeal that the matter had to be considered aggravated unlawful possession of firearms. When sentencing, emphasis was placed on the defendant's unreserved confession, and on the length of the proceedings. The defendant's appeal against the Court of Appeal's application of the law and sentencing was dismissed.
